I think the easiest way to tell if an administration official is lying, rather than merely mistaken, is to see if their lips are moving.
The VICP is not some little thing that might slip under a busy policy maker's radar. No, Steve Schmidt is knowingly lying.

Cap pain and suffering awards, and non-rich people lose the ability to attract a good lawyer. And without a good lawyer the non-rich won't win in court. And their non-good lawyers won't even be able to scare the malpractice insurance Co. to offer a decent settlement up front.
Come to think of it, why is lost income any more important than pain and suffering?
I'm thinking my paralyzed sister would much rather have her right brain and left side movement back than to have the income from her old job.
By the way, she has neither. She lost in court.
Both sides brought in a raft of "experts" and the lay jurors tried to figure out the complex issue in 2 days.

There is a committee which looks at these questions, and they concluded that there was no reason to add flu vaccine, because there was no evidence that litigation risk was substantial with flu vaccines, that there was concern about safety as there was with childhood vaccines, and because manufacturers did not want it. Presumably, if manufacturers thought there was significant risk, they would want it covered.
And while the clowns perform, something else more important is occurring in the shadows... better check your wallet before you leave the show... :)

The reduction in the number of vaccine manufacturers does seem to be at least partly due to legal risks - see http://www.heartland.org/Article.cfm?artId=14301 - so the Bush spokesman's quote is correct, in that if there were more vaccine manufacturers there would presumably be a less severe vaccine shortage, though there are other reasons for the shortage as well. Medpundit (http://medpundit.blogspot.com) backs this up to some extent and gives more background on the shortage.
The thimerosal cases show that the VICP is no protection against prosecution when you can be still be sued over a component of a vaccine.
