Wrong, Barry, it belies the claims made by David Neiwert that it was "unheard" of for a pilot to miss his physical. And it supports the numerous claims by Bush's superior officers that it happened all the time.

How does that make it other than dereliction of duty, disobediance to orders and a punishable offence, particularly if the officer doesn't take the physical later, after being ordered to?

This entire issue is up for discussion BECAUSE of the claim that Bush did something wrong in not taking his flight physical in 1972. Our host linked to a David Neiwert (Orcinus) post that was filled with errors, including that it was "unheard of" for this to happen to a pilot. Thus, was evidence of something unflattering about Lt. Bush.
However, it is untrue, if missing a physical is common, and/or the pilot's superior officers don't mind. It turns out that there are numerous such officers testifying it was no big deal at all. Therefore, your question is silly.
The REGULATION was that pilots needed to complete a flight physical by the end of the month in which their birthday occurs IF they were to continue to fly. That is it. There was no order to Bush to take the physical that anyone can produce, and Bush's superiors have said it was fine with them because he wasn't flying anyway.
