This was a big issue in Canada at the time the free trade deals were signed and was the main reason I opposed the treaties.

Opposing agreements that rig the rules of the global marketplace one way or another, a la Chapter 11 and its subsequent manifestations in numerous other FTAs, should not make one an "anti-trade protectionist."
As yesterday's NYT's article notes, Abner Mikva, a former chief judge of the federal appeals court in Washington and a former congressman, and currently a Nafta tribunal judge said, "If Congress had known that there was anything like this in Nafta, they would never have voted for it."

I agree with Adam that much of NAFTA and other recent trade liberalization treaties are more about international investment insurance and guarantees than free trade. But I don't know much about the details, and have depended on popular press and not *completely* objective journals (Nation) for info. I've looked for more objective info without much luck, and it looks these are good sources here. I might even find out if I'm really right, or have become a tinfoil type of guy on this subject.
